DejaWhere Terms of Service

The short version
- DejaWhere rebuilds your life timeline from your own data and lets you and someone you know see where your paths crossed before you met.
- You must be at least 16 [confirm], and you must only use DejaWhere with people who have agreed to it. Never use DejaWhere to track, follow or find out where someone is.
- Your data stays yours. You give us only the permission we need to run the service for you.
- "Crossed paths" is an estimate based on imperfect data. It is never proof that anyone was, or was not, somewhere.
- Subscriptions are bought through the App Store or Google Play and follow their refund rules. Printed products are made to order.
- We can suspend accounts that break these rules, and you can leave at any time.

1. Who we are and what these terms cover
These Terms of Service ("Terms") are an agreement between you and [TO FILL — legal entity name, company number, registered address] ("DejaWhere", "we", "us"). They cover the DejaWhere mobile apps, web app, website, and everything we offer through them (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use DejaWhere.
2. Who can use DejaWhere
- You must be at least 16 years old [confirm age with lawyer; align with the Privacy Policy].
- You must be able to enter into a binding agreement under the law where you live.
- You must not have been previously suspended or banned from DejaWhere.
- If you use DejaWhere on behalf of someone else, you must have their permission and they must also meet these requirements.
3. Your account
- Sign-in. You sign in with Google (or Apple on iOS). Keep those accounts secure; anything done through your account is your responsibility unless it was caused by our security failure.
- Phone number. Every account needs a verified mobile number, confirmed by a code sent through WhatsApp. One number belongs to one account. The number must be yours.
- Accurate information. Keep your name and contact details accurate. Don't impersonate anyone.
- One person, one account. Don't create multiple accounts, share your account, or transfer it to someone else.
- Tell us about problems. If you think someone has accessed your account without permission, contact us at [TO FILL — support email, e.g. support@dejawhere.app] right away.
4. What DejaWhere does — and what it does not do
DejaWhere reads traces you already have (photo metadata, calendars, Google Timeline and social-network exports, optional live location), fuses them on your device into "visits", and shows you your own timeline and map. With the explicit approval of one other person, or of everyone in a small group (3–6 people), it compares your timelines and shows Findings: where you crossed paths, visited the same places at different times, lived nearby, or have been together since you met.
Please understand the limits:
- Everything is an estimate. Your timeline is reconstructed from incomplete, sometimes inaccurate data (a photo's GPS can be wrong by hundreds of metres; a calendar entry does not prove you went). We show confidence levels and explain the evidence, but we can be wrong.
- "Crossed paths" is not proof. A Crossing means our data suggests you were both in roughly the same place around the same time. It does not mean you met, saw each other, or were definitely there. Times are rounded and distances are approximate. Likewise, the absence of a Finding does not prove you were not somewhere.
- Do not rely on DejaWhere for anything important. It is not evidence for legal, insurance, employment, custody, immigration or any other serious purpose, and must not be used to accuse anyone of anything.
- Coverage varies. How much of your life we can reconstruct depends entirely on the data you have. Some years may be empty.
5. Consent, sharing and how comparisons work
These are the rules for involving other people:
- Mutual approval, always. A comparison runs only when both people have approved it and its scope. Either person can decline without giving a reason. A group comparison (3–6 people) runs only once every invited member has explicitly joined.
- Snapshots only. Each comparison is a one-time snapshot. Running it again requires fresh approval — from both sides for a pairwise comparison, or from the whole group again for a group one.
- Only the shared part. The other person only ever sees the shared "Us" timeline (the Findings), never your personal timeline. Each of you sees only your own evidence. In a group, what a member can see about a pair they were not part of is limited to a place and a year, and only if both people in that pair chose to allow it.
- Private places are never shared, and Home and Work are never labeled (another person sees at most their neighbourhood, or their street if you are mutual Close Friends — never a house number), and same-day information is never matched. Your street address (Section 3.11 of the Privacy Policy) is never shared with anyone, in a pairwise or a group comparison.
- You can leave. You can end or block a Connection, or leave a group, at any time. This deletes the Findings (for the whole group, if it's a group) and closes the chat for both of you. The others may have already seen, screenshotted or shared the Findings, and we cannot undo that.
- Photos on Findings. If you choose to share a photo on a Finding, only the other person in that Connection can see it, and you can remove it at any time. Do not share a photo that shows other people who have not agreed to it.
- Findings belong to everyone they describe. Because a Finding is derived from more than one person's data, you may share it outside DejaWhere (for example as a share card) only with the knowledge of the people it describes, and never in a way that reveals their private timeline. 6. Acceptable use
DejaWhere exists to help people who know each other discover shared history. It must never become a tool for surveillance. You agree that you will not:
Tracking and stalking
- Use DejaWhere to track, follow, locate or monitor anyone, now or in the past, without their free and informed agreement.
- Use DejaWhere to find out where a person lives, works, or spends time, or to reconstruct someone else's movements.
- Pressure, trick or coerce anyone into connecting with you or approving a comparison, including a partner, ex-partner, family member, employee or child.
- Create a Connection or run a comparison with a person who has blocked you, or try to get around a block with another account.
- Import, upload or claim as your own any data that belongs to another person (for example another person's Google Timeline export, photos or calendar) in order to build a timeline that is not yours.
Fake or misleading timelines
- Fabricate, alter or import false data to create fake visits, fake Crossings or a misleading timeline.
- Use tools, scripts or edited files to manipulate the matching engine or our integrity checks.
Abuse of others
- Harass, threaten, intimidate, humiliate or deceive anyone through chat, Findings, shared photos or invitations.
- Send spam, unsolicited invitations in bulk, or repeated Connection requests to people who have not responded.
- Share photos or content that are sexual, violent, hateful, or that depict or involve minors in any inappropriate way, or that infringe anyone's rights.
Attacking the Service
- Reverse engineer, scrape, probe, overload or interfere with the Service, or try to access data that is not yours (including through the API, Bluetooth nearby tokens, or invite links).
- Use DejaWhere to build a competing service or a dataset of people's movements.
- Sell, rent or commercially exploit access to the Service or its data.
Breaking the law
- Use DejaWhere for anything that is illegal where you or the other person live, including violating anyone's privacy or data protection rights.
We enforce these rules with technical safeguards (rate limits, timeline integrity checks, mutual approval), a moderation queue, and human review. If you see abuse, use Report in the app or contact [TO FILL — safety email, e.g. safety@dejawhere.app]. If you are in immediate danger, contact local emergency services.
7. Your content and your data
- It's yours. You keep all rights to your photos, timeline, visits, edits, messages and anything else you bring to DejaWhere ("Your Content").
- The licence you give us. So that we can run the Service, you give us a worldwide, non-exclusive, royalty-free licence to store, process, encrypt, analyse, display and transmit Your Content only as needed to provide the Service to you and to the people you choose to share with, to produce products you order, and as described in the Privacy Policy. This licence ends when you delete the content or your account, except for content already delivered to others (for example a Finding the other person has seen, or a book that has been printed) and for backups that expire within 14 days.
- What we never do with it. We never sell Your Content or location data, never use it for advertising profiles, and never use it to train AI models. [Confirm: the planned "DejaWhere AI" feature is opt-in and uses only the user's own data at inference time; if that changes, this clause must change.]
- You are responsible for it. Make sure you have the right to import and share what you import and share, including photos of other people.
- Data sources belong to their providers. Google, Meta, Snap and Apple control their own export formats and APIs and may change or discontinue them. We are not responsible when a source stops working.
- Our stuff. DejaWhere, its name, logo, design, code, animations and any content we create (except Your Content and public map data) belong to us or our licensors. Map data is provided by Protomaps / Overture Maps under their own licences. You may not copy, modify or reuse our material without permission, except as allowed by these Terms.
- Feedback. If you send us ideas or suggestions, we may use them without owing you anything.
8. Free tier, Plus subscription and payments
8.1 Free tier and ads
The free tier includes the basic timeline, map, Cross Paths and limited history. It may show clearly labelled "Sponsored" cards. These ads are contextual and non-personalised; they are never based on your location history. We may change what is included in the free tier over time.
8.2 DejaWhere Plus
Plus is a paid subscription (currently: unlimited history, Wrapped for all years, advanced map, detailed stats, no ads — [confirm final feature split and pricing]).
- Bought through the app stores. Plus is purchased through Apple's App Store or Google Play, and managed by our subscription provider (RevenueCat). Prices are shown in the store before you buy and may vary by country. Prices include applicable taxes where the store says so.
- Auto-renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends, through your App Store or Google Play subscription settings. Uninstalling the app does not cancel a subscription.
- Refunds. Because the purchase happens through Apple or Google, refunds follow their rules and are requested from them, not from us. We cannot issue refunds for store purchases ourselves. [Lawyer: confirm this is compatible with Israeli Consumer Protection Law and EU consumer rights (14-day withdrawal for digital content, and waiver on immediate access).]
- Free trials and promotions. If we offer a trial, it converts to a paid subscription unless cancelled before it ends. Promotional prices apply for the stated period only.
- Price changes. If we change the price of Plus, the store will tell you in advance and you can cancel before the new price applies.
- Lost entitlement. If a store payment fails or is refunded, Plus features may stop. Your data is not deleted; only Plus features are affected.
8.3 Printed products (books and posters)
- Made to order. Books and posters are printed individually for you by our print partner (Gelato, or a fallback partner) and shipped to the address you give.
- Payment. Paid through Stripe at checkout. Prices, shipping costs, taxes and any customs duties are shown before you pay; customs duties in your country, if any, are your responsibility unless stated otherwise.
- Check before you order. You approve the layout and every photo before printing. For a couple's book, each person approves only their own photos. We cannot change or cancel an order once it has gone to print. [Confirm the cancellation window with Gelato.]
- Cancellation and returns. Because each product is personalised, the usual right to withdraw does not apply once production has started [Lawyer: confirm under Israeli Consumer Protection Law and the EU Consumer Rights Directive exemption for personalised goods]. If your product arrives damaged, defective, or different from what you approved, contact us within [TO FILL — e.g. 30 days] with photos and we will reprint or refund it.
- Content in prints. You are responsible for making sure you have the right to print the photos you choose. We may refuse to print content that breaks Section 6.
- Photo retention. Photos you upload for a print are deleted no later than 30 days after delivery.
9. Availability, changes and beta features
- We work hard to keep DejaWhere running, but we do not promise it will always be available, error-free, or compatible with every device.
- We may add, change or remove features, and we may require you to update the app to keep using it. Old app versions may stop working.
- Some features may be labelled beta or experimental; they may change or disappear without notice.
- Features that depend on third parties (Google Calendar, WhatsApp, Stream chat, app store billing, print partners, Bluetooth on your phone) may stop working if those third parties change or fail.
10. Ending your account
You can leave any time. Delete your account in the Privacy Center. This ends any active Connections, deletes Findings and chats, and destroys your encryption key so your location data becomes unreadable. Deletion is complete once backups expire within 14 days. Any active subscription must be cancelled separately through your app store.
We can suspend or end your account if you:
- break these Terms, especially Section 6 (acceptable use),
- create a real risk of harm to other people,
- are subject to a valid legal request requiring it,
- have not used your account for a very long time (we will email you first) [TO FILL — period], or
- if we shut down the Service (we will give reasonable notice and a way to export your data).
Where reasonable, we will tell you why and give you a chance to respond. For serious safety cases we may act first and explain afterwards. Ending an account does not affect rights and obligations that already arose, and Sections 4, 7, 11, 12, 14 and 15 survive.
11. Disclaimers
To the fullest extent allowed by law:
- The Service is provided "as is" and "as available." We make no promises about accuracy, completeness, reliability or fitness for any particular purpose.
- Findings are estimates, not facts. We do not warrant that any Crossing, Echo, Neighbors or Together Finding, or any visit on your timeline, is correct, or that the absence of one is meaningful. See Section 4.
- Other people. We are not responsible for what other users do with Findings, messages or photos you have shared with them, or for the accuracy of their data.
- Third-party services. We are not responsible for Google, Apple, Meta, Snap, Stream, Stripe, Gelato, RevenueCat or any other third-party service, including their availability or their handling of your data under their own terms.
- Emotional content. DejaWhere can surface memories, including of people or places you may not want to be reminded of. Use it in a way that is right for you; you control which sources and periods are included.
Nothing in these Terms limits rights that consumers have under mandatory law where they live.
12. Limitation of liability
To the fullest extent allowed by law:
- We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill or opportunity, arising from your use of the Service, even if we were told it was possible.
- Our total liability to you for all claims relating to the Service in any 12-month period is limited to the greater of (a) the amount you paid us in that period, or (b) [TO FILL — e.g. USD 100 / ILS equivalent].
- These limits do not apply to liability that cannot be limited by law, including for death or personal injury caused by our negligence, for fraud, for our wilful misconduct, or for breaches of mandatory consumer or data protection law.
[Lawyer: adapt for Israeli law and for EU consumer rules, where blanket exclusions may be unenforceable against consumers; consider a separate consumer-friendly clause for the EU.]
13. Your responsibility to us (indemnity)
If someone brings a claim against us because you broke these Terms, used DejaWhere to violate someone's rights, or shared content you had no right to share, you agree to cover our reasonable costs and losses from that claim. [Lawyer: confirm enforceability against consumers in Israel and the EU; may need to be limited or removed for consumers.]
14. Governing law and disputes
These Terms are governed by the laws of the State of Israel [confirm], and disputes will be heard in the competent courts of [TO FILL — e.g. Tel Aviv-Yafo], Israel [confirm]. If you live in the European Union or another country whose consumer laws give you the right to bring claims in your local courts under your local law, nothing here takes that right away.
Before going to court, please contact us at [TO FILL — legal email, e.g. legal@dejawhere.app]; we will try in good faith to resolve the issue within 30 days. EU consumers may also use the European Commission's online dispute resolution platform [Lawyer: confirm whether the ODR platform reference is still required or has been retired].
15. Changes to these Terms
We may update these Terms as the Service evolves. If a change is material, we will notify you in the app or by email at least [TO FILL — e.g. 14 or 30 days] before it takes effect, and continuing to use DejaWhere after that date means you accept the new Terms. If you don't agree, you can delete your account before the change takes effect. Changes required by law or for safety may take effect sooner.
16. General
- Whole agreement. These Terms, the Privacy Policy, and any store or in-app terms shown at purchase are the whole agreement between you and us about the Service.
- If part is invalid. If any part of these Terms is found unenforceable, the rest still applies.
- No waiver. If we don't enforce a rule immediately, we can still enforce it later.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor of the business, with notice to you.
- App store terms. If you downloaded DejaWhere from the Apple App Store or Google Play, their terms also apply, and Apple / Google are third-party beneficiaries of these Terms with the right to enforce them against you, as their developer agreements require. Apple and Google have no obligation to provide maintenance or support for DejaWhere.
- Language. These Terms are written in English. If we provide translations, the English version controls [confirm: for Israeli consumers a Hebrew version may need equal standing].
- Export controls and sanctions. You may not use the Service where doing so is prohibited by applicable sanctions or export laws.
